The evolution of drone legislation

drone-services-legislation

Update: this article dates from 2020 and reflects the regulations in force when it was published. For flying today, see drone regulations in Spain in 2026.

On 29 December 2017 the new regulatory framework governing the civil use of remotely piloted aircraft in Spain was published in the Official State Gazette (BOE). It is a new set of rules that introduces new scenarios.

Since 30 December 2017 this has been the law applying to the civil use of remotely piloted aircraft (RPAs) in Spain. Beyond any doubt or interpretation, it is the regulation that governs the use of drones.

Do I need a drone pilot licence?

Following the evolution of drone legislation, current drone regulations only require a pilot licence for people who will carry out professional work with professional drones. They must demonstrate theoretical and practical knowledge and hold an LAPL medical certificate (for drones <25kg) or a Class II certificate (for drones >25kg).

What do I need to work professionally with drones?

These are the requirements for professional use:

  • Be registered as an operator with Spain's State Aviation Safety Agency (AESA).
  • Hold a drone pilot qualification.
  • Have third-party liability insurance.
  • Hold a valid medical certificate.
  • Flights are only allowed in daylight and in favourable weather.

What rules apply if I fly for recreation?

These are the requirements for recreational use:

  • Fly at least 8km from any airport or aerodrome.
  • Fly outside controlled airspace.
  • Do not exceed 120 metres above the ground, or above the highest obstacle within a 150-metre radius of the aircraft.
  • Fly in daylight and in good weather.
  • Flights must always be within the pilot's visual line of sight (VLOS).
  • Aircraft under 250 grams may fly in towns and over crowds and buildings, provided they do not exceed 20 metres in height.
  • Third-party liability insurance is strongly recommended, although not compulsory.
